A DRINK driver has been fined £300 and disqualified from holding and obtaining a drivers license for two years.

Janet Kenny admitted driving on the A77 South near Bogend Toll, Symington after consuming so much alcohol that the proportion of it in her breath was 101 microgrammes of alcohol in 100ml of breath, on March 3.

This exceeded the the prescribed limit, namely 22 microgrammes of alcohol in 100ml of breath.

The 57-year-old appeared before Sheriff John Montgomery at Ayr Sheriff Court last Tuesday, April 19.

The court heard that police stopped Kenny's car, which had to be stopped three times, and decided to carry out a search. She told them she had drank a glass of wine that morning and was taken into the police station.

Speaking on her behalf, defence solicitor Mandy Malloy, said: "She is 57 years old, living with her daughter and separated from her husband. She suffered an injury at work in 2010 and was unable to work since.

"She has had mental health issues since then and relies on drink and needs help with her drinking. She has made an appointment with her GP this afternoon as she understands the serious condition she is in."

Sheriff Montgomery questioned: "Is that not what her doctor is for? Instead of going through the courts to get help?"

Miss Malloy replied: "I have told her that her GP should be her first port of call. She clearly appreciates she is going to be disqualified for a period of time."

Sheriff Montgomery addressed the dock: "I am naturally concerned about the amount of alcohol you had in your breath. I am not surprised that the police stopped you."

Ms Kenny will pay £30 per month from May 19. Her license has been endorsed.
