A THUG who robbed a man in his own home, headbutted him and demanded his car has been tagged.

Robert McMillan of Edenhall Road, admitted assaulting the man, repeatedly attempt to punch him and threaten him with violence last December.

The 45-year-old appeared before Sheriff Mhairi MacTaggart last week at Ayr Sheriff Court. The court heard how McMillan had already been placed on a non harassment order for a year.

Depute Fiscal Cath Whyte said: “The complainer saw him [McMillan] standing outside. Mr McMillan asked the complainer to hand over his car. He wanted money. The complainer gave him the £40 he had on him.

“The complainer went back inside and indicated that he had an injury. Police were contacted and the accused was detained.”
Speaking on his behalf, defence solicitor, Glenn Davies said: “He has a significant record. Last time he was before the court was in 2008 for an incident that occurred in 2007.

“He has mental health issues. He found the complainer with his partner. He is described as a very hard working and right minded individual. It was an unpleasant inquiry to say the least.”

Sheriff MacTaggart said: “I have to say I have given serious consideration to custodial sentence. I am going to make you subject to a restriction of liberty order. 

“This does not stop you from going out your house unless you go out in these hours and that will come back to me.”

McMillan has been fined £1,200 and will pay £100 per month. He has been made subject to a non harassment order for one year and has been told not to approach or contact the complainer.
