A MAN has evaded jail after striking a glass off a man's head in a Prestwick pub.
The victim's minor injuries saved Ryan McAteer from a spell in prison, Ayr Sheriff Court heard on Tuesday, December 4.
28-year-old McAteer attacked his victim in Elliot's on Prestwick's Main Street in April this year.
Depute Fiscal Stewart McMillan told the court: "The accused approached the complainant, words were exchanged and he struck him with a glass to his head."
Thankfully, McAteer's injuries were not significant and no stitches were required, which weighed in on Sheriff Desmond Leslie's verdict. He said: "There are two things keeping you out of jail. There is no record of violence on your record, and this man was not seriously injured. That is a matter of good fortune as far as you're concerned."
Instead, Sheriff Leslie instructed McAteer to pay his victim £300 compensation and a further fine of £400 to the court.
